Terms and conditions

Elie Leisure Company Ltd trading as Catchpenny Safari Lodges Bookings & Payments

All bookings via our online system should be treated as provisional until you receive confirmation from us via email. To secure your booking a deposit of 30% (or full payment) of the cost of your stay is required.  Bookings must be paid in full 4 weeks before your arrival date. If the booking is less than 4 weeks from the date of your stay the full price of the stay is required at the time of booking.  Confirmation of the booking will be sent after the deposit, or full payment, has been received. If the balance is not paid by the due date Catchpenny Safari Lodges reserves the right to re-let the lodge and retain the deposit. 

When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. Catchpenny only accepts bookings from persons over 25 years of age. Catchpenny reserves the right, at all times, without statement of reasons, to refuse or cancel a booking. The prices featured on the website are not binding; Catchpenny reserves the right to modify these prices. At the time of booking you will be informed of the prices applicable. The price stated on the confirmation invoice is binding.   

Group Bookings

It is the right of Catchpenny to refuse group bookings if we feel that this may be of detriment to other guests.

Stag & Hen Parties

We do not permit Stag or Hen Parties.

Security Deposit

All bookings are subjected to a £250 damage deposit held against the card used to make the booking.

Arrival & Departure Times

We ask that you arrive on your specified arrival date between 4:00pm – 5.00pm; we do understand that sometimes this may be inconvenient or events occur to make this very difficult.  It is not as simple as arriving at a hotel and therefore it’s preferable to arrive in daylight.  If you are unable to arrive between these hours then Catchpenny does not guarantee someone will be there to meet and greet.  Please inform us in advance if possible if you are going to arrive after 5.00pm. Guests are requested to vacant their lodge by 10:00am on the date of their departure. 

Cancellations

If you cancel more than 4 weeks prior to your arrival date, we will refund your deposit less a £50 cancellation charge. If you cancel within 4 weeks of your arrival date we will attempt to re-let your lodge.  If we are able to re-let your lodge, we will refund all monies paid less a £50 cancellation charge.  If we are unable to re-let your lodge, we regret that we will not be able to refund any monies paid.

Day visitors

Are welcome but please ensure only the Visitor parking is used. All day guest must be pre agreed with the owners, names and car registration numbers must also be provided along with contact details, should we, in the case of an emergency, need to know who is on site. All day guests must vacate the site by 10pm.  

Pets

At Catchpenny we welcome people to bring their dogs (subject to a £20 supplement per dog) but ask that dog owners are respectful of other guests.  Dogs should be on a lead at all times and dog foul should be picked up and disposed of promptly.  Catchpenny reserves the right to request that dogs causing a nuisance are removed from the site. Guest Behaviour - The holiday; guest conditions of occupancy and conduct The Guests have the right to occupy the Property for the paid for holiday period only within the meaning of Schedule 1 Paragraph 9 of the Housing Act 1988.  

Guests undertake to behave in a proper, appropriate and legal manner with due respect to the Owner, the Property and other guests and their property. If any guest behaves inappropriately or improperly (of which the Owner will be the final judge on their Property), or illegally, the Owner reserves the right to ask the guest and their party (at their discretion) to leave the Property before the end of the holiday period. Any refund for so doing will be at the entire discretion of the Owner. In addition, the Owner reserves the right to sue the guest for any loss, damage or injury caused to the Owner, the Property or to other guests and/or their property. We ask that guests keep noise to a minimum after 10.30pm and before 8am, in consideration of others, and our local neighbours 

Smoking

There is a strict no smoking policy in any of the lodges at Catchpenny.  Smoking is permitted outside and around fire pits but we ask you to be respectful of the other guests and dispose of cigarette butts appropriately. If it is evident that guests have been smoking in the lodge then the security deposit will not be refunded to compensate for the additional cleaning and delay in being able to re-let the lodge. 

Littering

We are committed to protecting the natural environment. Separate recycling bins are provided in the lodges and guests are asked to use the recycling bins provided at the carpark. Should any facilities, equipment, or inventory become damaged over the duration of your stay, you will be held responsible for the cost of repair or replacement of that item. The company cannot accept responsibility for any loss, damage, or expense arising from industrial action, terrorist activity, adverse weather conditions or any other event outside the control of the company. 

Additional Cleaning

All cleaning under normal circumstances is included in the cost of your stay. If additional cleaning of the lodge is required, including washing up, additional cleaning of the interior or fixtures and fittings then Catchpenny reserves the right to charge for this work at a rate of £15 per hour. Catchpenny reserves the right to deduct this payment from your security deposit or invoice guests following their stay.  

Candles & Fires

Naked flames are not permitted in the lodges at any time. Please do not leave any candles used on the outside deck, or fires unattended.  It is not permitted to use the fire pits on the wooden deck. By booking and coming to Catchpenny you agree to be responsible for your children and any children you are in charge of, whether on the site or by the sea, and your own welfare and to take all reasonable precautions against personal injury, injury to others and damage to facilities and lodge.  Catchpenny guests are requested to respect the privacy of the neighbouring farm where large machinery is a very serious danger to children.  Access to the farm shop is strictly via the Catchpenny driveway and along the public pavement and NOT across the field and through the farm.

Breach of Booking Conditions

If there is a breach of any of these conditions by the Guest or any of their party, the Owners reserve the right to re-enter the Property and end the holiday and ask the Guest and their party to leave in addition to their other rights specified in these Booking Conditions. Ending the Holiday by the Owners or the Guests does not affect that party’s other rights and remedies. 

Governing Law and Jurisdiction

Any dispute will be governed by the non-exclusive law and jurisdiction of the Scottish Courts. Authority to Sign – the person who signs the Booking Form certifies that: - he or she is authorised to agree the Booking Conditions on behalf of all persons included in the Booking Form, including those substituted or added at a later date; - the signatory is over eighteen years of age; - they agree to take responsibility for the party occupying the Property, and to notify the Owners if they are not a member of the holiday party. Nothing in these conditions excludes or limits the liability of the Owners: - for death or personal injury caused by the Owners negligence. - for any matter which it would be illegal for the Owners to exclude or attempt to exclude their liability. Recreational activities on the beach and by the sea and any other activity on the Owners land is the responsibility of the Guest and is done so at their own risk. We strongly recommend that you take out travel insurance against the risk of accidents and your stay being cut short. 

Liability

Catchpenny accepts no liability for theft, loss or damage, of whatever nature, during or as a result of a stay at Catchpenny.  - the tenant and those who accompany him or her, are jointly and severally responsible for all loss and/or damage which arises, Catchpenny and/or any third party as a direct or an indirect consequence of their stay, irrespective of whether this was caused through actions or refraining from actions by themselves or by third parties, who are at Catchpenny their making, as well as of all damage which is caused by matter which they have under their responsibility. - If you leave your tent in an improper condition, additional (cleaning) costs can be charged. 

Force majeure  

Force majeure on the side of Catchpenny exists if the implementation of the agreement is entirely or partially, temporarily or permanently, prevented due to circumstances which are beyond the control of Catchpenny including threat of war, staff strikes, blockades, fire, floods, storms and other disruptions or events. 

Complaints  

Despite all the care of Catchpenny it could occur that you have a genuine complaint. You must take up this complaint with the Owner immediately, in order to allow us to solve the matter as soon as possible. Should the complaint not be settled to your satisfaction, then you have the option, up to 14 days after your departure to submit the complaint in writing or by email to the Elie Leisure Company. In the event that a court finds that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the remainder of the Booking Conditions, which will continue to be valid and have full force and effect.
